Terms of Service
Last updated: 17 October 2026
1. About the service and these terms
Independent Movers is a mobility, strength and balance program for older adults, created by an Accredited Exercise Physiologist and delivered through our app and website (together, the "service"). It is run by Independent Movers of Melbourne, Victoria ("we", "us", "our").
These terms apply when you use the service. By creating an account, or by using the service, you agree to them. Please read them with our Privacy Policy and Refund Policy.
2. Your health and safety
The service gives general exercise guidance and education. It is not medical advice and does not replace an assessment or treatment by your doctor or another health professional. The program is set from your own answers to the safety questions and the assessment, and no one from our team watches you exercise unless you book a consultation or a call.
- Talk to your doctor before you start, especially if you have a health condition, have had a fall or take medicine that affects your heart rate.
- If you answer "yes" to any safety question, you must get a doctor's clearance before you continue. If the app suggests you see your doctor, please do so before you carry on.
- Exercise in a safe, clear space, with something sturdy to hold and someone nearby where the program suggests it.
- Work within your limits. Stop if an exercise feels unsafe or your pain is above 3 out of 10, and use the "Too hard" button.
- Stop straight away and get medical help if you have chest pain, dizziness, unusual shortness of breath or sharp pain. In an emergency call 000.
- Tell us, and your doctor, if your health changes.
All physical activity carries some risk of injury. You choose to take part, and you are responsible for deciding whether each exercise is right for you on the day.
3. Who can use the service
You must be 18 or over to create an account. The program is designed for older adults living independently in Australia. A family member or friend may help you set it up, but the account must be in your name and the answers must be about you.
4. Your account
To use the app you need an account. We ask for your name, email address, year of birth, a password and, if you like, your phone number, and we confirm your email address with a code. Please keep your details accurate and up to date. Your account is for you only: keep your password private, do not share your account, and tell us straight away if you think someone else has used it.
5. Information we collect and how we use it
When you use the app we keep your safety answers, assessment results, program and progress so we can give you your program. We handle all of it as set out in our Privacy Policy, which also explains how to see, correct or delete your information.
Anonymised results. If you agree, by ticking the box when you sign up or later in Account > Privacy, we may use your results, with your name and contact details removed and combined with other members' results, to report how well the program works and to improve it, and we may publish those totals. This is optional and you can change your mind at any time. See section 5 of our Privacy Policy.
6. Community features
You can add friends, send nudges and cheers, and share sessions to a news feed. Please be kind and respectful. Do not use these features to send anything offensive, misleading or unwanted, to collect other members' details, or to promote a business. We may remove content, or limit or close an account, that breaks these rules.
7. Your story and photo
If you send us your story (a testimonial), with or without a photo, you confirm that it is true, that it is about your own experience, and that the photo is of you. You keep ownership of it. If you tell us we may share it, you allow us to publish it, free of charge, on our website, in our printed material and on social media, in the way you chose (with your first name and last initial, or without your name), and we may shorten it without changing its meaning. You can ask us to take it down at any time, and we will remove it from what we control within 14 days.
8. Prices, trials and payment
While we test the app, the program is free. We will tell members well before that changes, and nobody will be charged without choosing a plan first.
Once paid plans start, prices are shown on our pricing page and before you pay, in Australian dollars including GST if it applies. A free trial, where offered, needs no card details, and nothing is charged automatically when it ends. Payments are taken by our payment provider, whose terms also apply. If you pay in monthly payments, you agree to pay each one when it is due. We may change our prices, but a change will not affect a plan you have already paid for. Refunds are covered by our Refund Policy.
Inviting a friend. Each member has a referral code. When someone who is new to Independent Movers creates an account with your code and then pays for a plan, you and they each get one free month (30 days). You can earn up to 12 free months by inviting friends. A free month lengthens your free trial or, if you already have a plan, pushes back your next renewal date by a month. They have no cash value and cannot be transferred or exchanged. Please invite only people you know who may be interested, and do not create accounts or use other people's details to earn free months; we may remove free months earned that way. We may change or end the offer, but free months already earned will be kept.
9. Our content
The program, exercises, videos, articles, text, graphics, logo and software in the service belong to Independent Movers or the people who license them to us, and are protected by copyright. You may use them for your own personal, non-commercial use, and print pages for yourself. You may not copy, share, sell, publish or adapt them, or use them to build a competing program, without our written permission.
10. Using the service fairly
Please do not try to get into other members' accounts or parts of the service that are not meant for you, copy content in bulk or with automated tools, interfere with how the service works, or use it for anything unlawful.
11. Other services we use
The service relies on providers such as Neon (database), Netlify (hosting), Resend (email), Bunny.net (videos) and, from launch, a payment provider. Links to other sites and apps, such as Messenger or WhatsApp when you invite a friend, are there for convenience: we do not control those sites, and their own terms apply.
12. Availability and changes to the service
We work to keep the service available and accurate, but we cannot promise it will always be uninterrupted or error-free. We may improve or change the program, exercises and features from time to time, for example to follow new clinical advice.
13. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those rights.
14. Our responsibility
As far as the law allows, and apart from your rights in section 13, we are not responsible for injury, loss or damage that arises because you did not follow the program's instructions and safety guidance, gave inaccurate answers to the safety questions or assessment, kept exercising against medical advice, or used the service in a way these terms do not allow. We are not responsible for loss caused by events outside our reasonable control.
15. Security
We take reasonable steps to keep your information secure, as described in our Privacy Policy. No system is completely secure, so please use a strong password that you do not use anywhere else.
16. Ending your use
You can stop using the service at any time and ask us to close your account and delete your information. We may suspend or close an account that seriously or repeatedly breaks these terms, or if we stop offering the service. Unless you have seriously broken these terms, we will give you reasonable notice first and refund any part of a paid plan you cannot use.
17. Changes to these terms
We may update these terms when the service or the law changes. The latest version is always on this page, with the date it was last updated. If we make a significant change, we will tell you in the app or by email at least 14 days before it takes effect. If you do not agree, you can close your account before then.
18. Governing law
These terms are governed by the laws of Victoria, Australia, and you and we can bring proceedings in its courts.
19. If part of these terms cannot apply
If a court decides that any part of these terms is invalid or cannot be enforced, that part is removed and the rest of the terms still apply.
